Any confirmation by the buyer referring to their own terms of business or purchase is expressly rejected. The Gut Hügle Online Shop processes your data to handle orders and tailor its offer to your needs. We will never disclose or make your data available to unauthorised third parties.

§2 Use

1. The Gut Hügle Online Shop sells only to natural persons with full legal capacity and to legal entities. Use by minors is excluded.

2. The information required to register or place an order, such as your name, address and email address, must be provided in full and truthfully.

3. Registration for and use of the Gut Hügle Online Shop are free of charge.

4. If an order is placed and confirmed by the Gut Hügle Online Shop, the purchase and delivery costs stated in the offer will apply.

§3 Prices

1. All offers on the Gut Hügle Online Shop website are non-binding. The prices in effect when the order is placed apply. The validity period of time-limited offers is shown separately in the online shop.

2. The prices applicable on the day the order is placed apply. They are also shown on the online invoice.

3. All prices shown and other price components include VAT at 10,7% and 19% and apply only to deliveries within Germany.

§4 Contract

1. The purchase contract is concluded when the Gut Hügle Online Shop confirms the order in writing (by email).

2. If, contrary to expectations, a product cannot be delivered for reasons beyond our control despite timely procurement arrangements, the Gut Hügle Online Shop is entitled to withdraw from the purchase contract.

§5 Right of withdrawal under § 355 BGB

1. The customer may return the goods free of charge and without stating a reason within two weeks of receiving them. Sending the goods within this period is sufficient to meet the deadline.

The customer must pay the return shipping costs if the goods delivered match the order and the price of the item being returned does not exceed 40 Euro, or if, for an item costing more, the customer has not yet paid at the time of withdrawal. Otherwise, returns are free of charge for the customer. In the case of incorrect deliveries, all costs are borne by the sender (Gut Hügle Online Shop).

2. The goods must be in a condition suitable for resale. If the goods deteriorate (for example, due to obvious signs of use) or are lost before being returned, the customer must compensate for the reduction in value or the value of the goods, up to the purchase price. The withdrawal period is met if the goods received are sent back on time.

3. The purchase contract is cancelled once the goods have been returned within the deadline. Any payments already made will be refunded to the customer’s bank account.

5. Perishable goods, including cherries, may not be accepted for return once opened, for hygiene reasons.

6. Goods intended for return should be sent back as complete as possible, preferably in their original packaging, at the recipient’s risk. In all cases, the goods must be packed suitably for safe transport, with a copy of the delivery note enclosed.

7. The customer is responsible for any damage or delays resulting from failure to comply with these requirements.

§6 Warranty

1. You must notify the Gut Hügle Online Shop of obvious defects in the goods, including transport damage, without delay and no later than 2 working days after delivery. Notify us by email, stating the reason if possible, at

2. If this deadline is missed, warranty claims for an obvious defect are excluded.

§7 Delivery

1. The Gut Hügle Online Shop delivers goods to the delivery address provided. Any shipping costs are listed in the delivery terms for the products offered and in the order confirmation. If a delivery under the gift service is not accepted, the Gut Hügle Online Shop may charge an additional shipping fee equal to the initial shipping costs for a new delivery. The Gut Hügle Online Shop may also charge bank fees of EUR 10,00 or the costs incurred for its efforts directly if the customer enters incorrect account or card details.

2. If you default on acceptance or delivery is delayed for other reasons for which you are responsible, the risk passes to you from the date you are notified that the goods are ready. In this case, the purchase price also becomes due on the date you are notified that the order is ready to ship.

3. The right to claim further damages remains unaffected.

5. The Gut Hügle Online Shop does not enter into fixed-date transactions.

The same applies if the Gut Hügle Online Shop is already in default when any such event occurs.

3. The Gut Hügle Online Shop reserves the right to amend these General Terms and Conditions at any time and without stating a reason.

4. Such amendments do not apply to orders already placed. By placing an order, the customer accepts the General Terms and Conditions in force at that time.

5. In transactions with consumers, the law of the consumer’s place of residence also applies where the relevant provisions are mandatory consumer-protection rules.

6. If the customer is a businessperson within the meaning of the German Commercial Code, a public-law special fund or a legal entity under public law, Ravensburg is agreed as the exclusive place of jurisdiction.

7. If any provision of these terms is invalid, the remaining provisions remain unaffected.

§12 Applicable law and written form
