1. Subject matter and scope of these terms of use
These terms of use govern your and our rights and obligations in connection with the use of our guest Wi-Fi access.
2. Our services
(1) We provide free internet access in the form of a Wi-Fi connection (“hotspot”) for your use at our premises.
(2) We provide the hotspot subject to our current technical and operational capabilities. You are not entitled to a functioning hotspot or coverage in any particular area.
(3) We also do not guarantee that the hotspot will be available without faults or interruptions, or that it will provide any particular connection speed.
(4) We reserve the right to change, restrict or suspend access to the hotspot without prior notice if technical repairs or maintenance are required.
(5) You are not entitled to use any particular services through the hotspot. We may, in particular, block certain ports. Internet browsing and sending and receiving email are generally available.
3. Access and use
(1) Our guest Wi-Fi is available only to visitors to our business. It is not a publicly available telecommunications service, but an internal Wi-Fi network for our guests.
(2) To use the hotspot, you must first register and/or accept these terms of use when you begin using it. When you select the hotspot as a Wi-Fi network on your device, this can usually be done using the registration form or welcome page that then opens.
(3) You have no entitlement to use the hotspot. We may restrict or suspend access to it at any time without giving reasons.
(4) The current version of these terms of use applies and is available when you register for the hotspot.
4. Login details
(1) If you provide login details during registration (such as a username, password or email address), you must keep them confidential and prevent unauthorised third parties from accessing them.
(2) If you receive registration details, you must ensure that only you, as the user, access and use the hotspot with your credentials. If there are grounds to believe that an unauthorised third party has learned or may learn your login details, you must inform us without delay.
(3) As the user, you are liable under the law for any use or other activity carried out using your login details.
5. Your obligations as a user
(1) You must provide truthful information about yourself when asked as part of using the service.
(2) You must comply with applicable laws when using our hotspot.
(3) Any further obligations arising from other provisions of these terms of use remain unaffected.
6. Fees
The service is provided free of charge.
7. Service availability
As our services are provided free of charge, you have no entitlement to use the hotspot. We nevertheless make every effort to keep it available with as few interruptions as possible.
8. Prohibited conduct
As a user, you must not use the hotspot for any activity that violates applicable law, infringes third-party rights or breaches child-protection rules. In particular, the following activities are prohibited:
uploading, distributing, offering or promoting pornographic, fraudulent or other content, services and/or products that violate child-protection laws, data-protection law or any other law;
publishing or making available content that insults or defames other participants or third parties;
using, providing or distributing content, services and/or products that are protected by law or subject to third-party rights (such as copyright) without express authorisation;
making copyrighted works publicly available or otherwise infringing copyright, particularly by using so-called “internet file-sharing” or peer-to-peer services;
In addition, regardless of whether an activity violates the law, the following activities are prohibited when uploading your own content to the service provider’s website or communicating with other users (for example, by sending private messages or taking part in discussion forums):
transmitting exceptionally large amounts of data, particularly on a sustained basis;
hosting a web server or other servers using a hotspot provided by the service provider;
changing the DNS servers specified in the service provider’s hotspot network settings
sending junk mail, spam or chain letters;
distributing viruses, Trojans or other malicious files;
distributing or communicating suggestive, offensive, sexually explicit, obscene or defamatory content, or content or communication that could promote or support racism, fanaticism, hatred, physical violence or unlawful acts (whether explicitly or implicitly);
asking other users or third parties to disclose passwords or personal data for commercial purposes or for purposes that violate rights or the law;
Any activity likely to disrupt the smooth operation of our hotspot is also prohibited, particularly placing an unreasonable burden on our systems.
9. Blocking access
We may temporarily or permanently block a user’s access to the hotspot at any time if there are specific indications that you are violating or have violated these terms of use and/or applicable law, or if we have another legitimate reason to block access.
10. Indemnification
(1) As the user, you are responsible for all actions you take in connection with using the internet through our hotspot.
(2) You must indemnify us, on first demand, against all claims brought against us by third parties because of a user’s breach of legal requirements, third-party rights (particularly personality rights, copyright and trademark rights), or contractual obligations, assurances or guarantees. This includes the necessary costs of legal defence (lawyer and court fees at the statutory rates).
(3) If claims within the meaning of section 10 paragraph 2 are asserted, you must cooperate promptly and fully in clarifying the facts and make the necessary information available to us in an appropriate manner.
11. Limitation of liability
(1) We are fully liable for all damage we cause intentionally or through gross negligence.
(2) In cases of slight negligence, we are fully liable for injury to life, body or health.
(3) In all other cases, we are liable only if we breach a material contractual obligation. Material obligations are those whose fulfilment is essential to proper performance of the contract and on whose observance the user may regularly rely. In such cases, liability is limited to compensation for foreseeable damage that is typical for this kind of contract.
(4) Any exclusion or limitation of our liability under the provisions above also applies to our agents.
(5) Liability under the German Product Liability Act remains unaffected.
12. Data protection
(1) We ensure that your personal data is collected, stored and processed only where this is necessary to perform the contract and permitted or required by law.
(2) If we obtain your consent to data processing under data-protection law when you use our services, please note that you may withdraw it at any time with effect for the future.
(3) We need to use personal data from your device to provide the hotspot services. In this context, MAC addresses of devices may also be stored temporarily. We may also store log data (“log files”) about the type and extent of service use for 7 days. This data cannot be directly linked to you.
13. Final provisions
(1) The law of the Federal Republic of Germany applies; the UN Convention on Contracts for the International Sale of Goods is excluded.
(2) If you are a businessperson, a legal entity under public law or a special fund under public law, our registered office is the exclusive place of jurisdiction for all disputes arising from the contractual relationship.
(3) If any provision of these terms of use is or becomes invalid, the validity of the remaining provisions is unaffected.
